1. By entering the Win a trip to Wellington competition you accept the terms and conditions set out below (Terms).

2. Employees of Positively Wellington Tourism, Air New Zealand and their immediate family members are not eligible to enter the competition.

3. You must be 18 years of age or older to enter the competition. If requested by Positively Wellington Tourism, you must provide proof of your age and/or place of residence.

4. Only correctly complete entries will be accepted. Positively Wellington Tourism accepts no responsibility for any entries which are lost, delayed or not received for any reason, or for any subsequent error, technical malfunction, loss, omission, communications delay or failure.

5. All decisions of Positively Wellington Tourism in relation to the competition shall be final and no correspondence will be entered into.

6. Entries close midday Monday 28 November 2011 (Australian time).

7. Only one entry per person is permitted.

8. The winner of the competition will be drawn at random from the eligible entries on Friday 2 December 2011 at the offices of Positively Wellington Tourism, Level 28, Grand Plimmer Tower, 2-6 Gilmer Terrace, PO Box 10 017, Wellington, New Zealand, and will be notified by email on Monday 5 December 2011. If the winner does not reply to their winner’s notification email by 9am Wednesday 7 December 2011 (Australian time), a second prize draw will be undertaken. In the event of a second prize draw, if the new winner drawn does not respond to their winner’s notification email within a reasonable time (determined by Positively Wellington Tourism), a third prize draw will be undertaken, and so on until the winner is finalised.

9. One prize package will be offered to the winner of the competition draw. The winner’s prize package is valued at AUD$4000 and includes the following for the prize winner and their travel companion:

- Two return economy “Works” fares from Melbourne to Wellington on Air New Zealand, prize is inclusive of government taxes and surcharges.
- Two nights accommodation at CQ Hotel, in the heart of Cuba Street.
- Lunches for two at the Larder in Miramar, and Boulcott Street Bistro in Wellington City.
- Dinners for two at Logan Brown Restaurant and Capitol Restaurant in Wellington City.

10. Except as set out in the prize packages above, all other expenses, such as transfers to departure airports or to and from Wellington attractions, spending money, travel insurance, meals and any other ancillary costs of taking up the prize package will be at the winners’ own expense.

11. The prizes cannot be used in conjunction with any other offer.

12. Where relevant, the prize winner shall be responsible for obtaining all necessary visas and any other immigration approvals required by Immigration New Zealand or otherwise to be able to travel to New Zealand. Positively Wellington Tourism accepts no responsibility or liability incurred due to the failure to obtain any such approvals.

13. All relevant prize package components must be booked and confirmed by the prize winner by 1 March 2012. Details on how to book will be provided in the winner notification email.

14. All travel in the travel prize package must be completed by the prize winner and their travel companion between 16 Jan 2012 – 30 June 2012 and must be undertaken by the prize winner and the winner’s companion together at the same time, on the same itinerary. If for any reason whatsoever the prize winner and their companion cannot redeem the prize within this specified period, they shall not be entitled to compensation and the prize package shall become void.

15. By accepting a prize, the prize winner consents to Positively Wellington Tourism using his/her details and photographs for promotional and media publicity purposes.

16. All flights, accommodation and attraction/activities are subject to availability at time of booking. Blackout dates may apply at certain times to flights, accommodation and activities at the sole discretion of each prize component’s supplier.

17. Positively Wellington Tourism and their associated agents act only as agents or resellers for other parties (suppliers) who provide the component parts of each prize package. Individual suppliers’ standard policies and terms and conditions apply to the prize package components. All tickets, coupons and exchange orders issued in respect of any prize package component provided are subject to the individual supplier’s terms and conditions.

18. Positively Wellington Tourism accepts no responsibility for an individual suppliers failure to supply the prize for any reason, or in the form expected, and are not obliged to provide an alternative prize or take legal action to require the supplier to carry out their obligations.

19. Prize components are subject to change by Positively Wellington Tourism and the individual suppliers without notice.

20. All prize components are non-refundable for cash either in part or in whole and are not transferable to any persons, unless agreed in writing by Positively Wellington Tourism.

21. Any additional person, upgrade, extension or variance from the prize package (where permitted by the relevant supplier) will be at the prize winner’s own expense.

22. Positively Wellington Tourism reserve the right in its sole discretion to disqualify an entrant who it considers to be ineligible or who tampers with the competition entry or draw process, or who fails to comply with these Terms.

23. Positively Wellington Tourism reserves the right to vary these Terms or to modify, suspend, terminate or cancel the competition at any time without notice, and for any reason.

24. Positively Wellington Tourism shall not be liable for any loss or damage whatsoever which is suffered by you (including but not limited to direct or consequential loss) in connection with this competition or for any personal injury suffered or sustained in connection with any prize/s. By entering the competition you agree to indemnify Positively Wellington Tourism in respect of any claim, accident, injury, damage or loss which may arise in connection with the competition or any prize.

25. These Terms shall be governed by and construed according to the laws of New Zealand. You agree that the Courts of New Zealand shall have exclusive jurisdiction over any dispute which may arise in connection with these Terms, unless otherwise agreed by and Positively Wellington Tourism.

27. Positively Wellington Tourism may collect personal information provided with your entry, which will be used to notify prize winners, verify entries, and generally administer this competition. Positively Wellington Tourism respects privacy rights under the Privacy Act 1993 and will comply with the privacy principles in relation to the collection of any personal information from individuals entering this competition.
